(Natural News) Hershey Co. is facing a major lawsuit from a consumer who claims the dark chocolate the company sells is loaded with potentially harmful heavy metals, cadmium and lead.

According to Reuters, in a proposed class action lawsuit filed this week, Christopher Lazazzaro said he never bought or paid less for Hershey’s Special Dark Mildly Sweet Chocolate, Lily’s Extra Dark Chocolate 70% Cocoa and Lily’s Extreme Dark Chocolate 85%. Cocoa if the company had disclosed heavy metal content.

The lawsuit was filed Wednesday in federal court in Central Islip, NY. The company did not respond to Reuters for comment.

Interest in chocolate has grown due to its physiological and potential health effects such as regulation of blood pressure, insulin levels, vascular function, oxidation processes, prebiotic effects, glucose homeostasis and lipid metabolism.

Lazazzaro, a resident of Nassau County in New York, filed a lawsuit two weeks after Consumer Reports published the results of scientific testing of 28 dark chocolate bars aimed at measuring lead and cadmium levels. The consumer magazine found that although all the bars contained some amount of heavy metals, 23 of them, including chocolates from Dove, Godiva, Lindt and Trader Joe’s, contained what they considered to be levels of lead, cadmium or both for each, who named it consumes an ounce of dark chocolate daily.


“Hershey’s Special Dark bar and Lily’s 70% bar were high in lead, and Lily’s 85% bar was high in lead and cadmium, the magazine said,” according to Reuters magazine. “Lazazzaro said that reasonable consumers are put off by such levels because they pose a ‘serious health risk,’ and that consumers rely on Hershey to truthfully disclose the ingredients in its products.”

While the accuracy of the tests is undisputed, Consumer Reports would have been more honest if they reported the actual ppb (parts per billion) or ppm (parts per million) values ​​of the bars, rather than comparing them to Prop 65 regulations in California that are misleading and not based on solid science. For example, consuming 500 nanograms of lead in a candy bar is safe for health and should not be used to overly alarm consumers. We found lead levels 100 times higher in some rice protein products as well as certain probiotics still sold on Amazon, and Consumer Reports hasn’t looked at those results yet. When we brought these numbers to Whole Foods, who were selling some of these products, they showed no interest and continued to sell these products to unknowing consumers. Yes, there is a lot of lead in the food supply, but no, candy bars are not the primary vector of exposure.

His lawsuit seeks a minimum of $5 million in damages and a minimum of $500 per transaction under New York state law.

“A number of positive effects on the cardiovascular system can occur after regular intake of cocoa-containing foods and beverages. Benefits include effects on blood pressure, insulin resistance, and vascular and platelet function,” the 2019 study states. “Polyphenols, abundant in cocoa and dark chocolate, activate endothelial NO synthase; this leads to the formation of NO, which lowers blood pressure by promoting vasodilation.

“Indeed, after consuming dark chocolate, the effects include improvement in pulse wave velocity and atherosclerosis score index, with parietal relaxation of the large arteries and dilatation of the small and medium-sized peripheral arteries. Higher concentrations of epicatechins in plasma aid in the release of endothelium-derived vasodilators and increase concentrations of plasma procyanidins, leading to higher NO production and bioavailability,” the study adds.

Previous studies have shown that exposure of children to heavy metals can lead to higher cases of autism. According to a study published in the journal Biological Trace Element Research, children with autism spectrum disorders had higher levels of several toxic heavy metals — such as lead, thallium, and tin, as well as mercury and cadmium — compared to their healthier peers.

“We hypothesize that reducing early exposure to toxic metals may help reduce symptoms of autism and that treatment to remove toxic metals may reduce symptoms of autism. These hypotheses need further investigation as there is a growing body of research supporting them,” the researchers said in Science Daily.
