(Natural News) The U.S. Supreme Court made the right decision this week, allowing a Trump-era immigration and border security rule, Title 42, to remain in effect while lower courts decide whether states adopt it and continue to enforce it can.

The rule was introduced by then-President Donald Trump to give border officials the power to immediately escort anyone who entered the United States illegally back across the border into Mexico while the COVID-19 pandemic was raging.

The Biden regime has attempted to end the rule since Joe Biden was installed in the White House, but later federal courts have ruled that he has no authority to end it arbitrarily without following the law. Now the country’s highest court has ruled that the rule must remain in effect until lower federal courts have clarified it. If the Supreme Court were to phase out the rule, illegal crossings, which have already peaked, would have more than doubled, experts predicted.

“With the clear support of President Joe Biden, Secretary of Homeland Security Alejandro Mayorkas has called for an end to border control policies, but the Biden administration has failed to go through the legal process to end the CDC measure,” Breitbart News reported after the Supreme Court ruling. “When leftist groups sued to end the program, Attorney General Merrick Garland instead chose not to appeal a lower court ruling against the policy, which would result in Title 42 being ended.”

“But 19 states filed motions to intervene in the case, asking the courts to allow states to follow in the Biden administration’s footsteps to defend the policy and issue a stay of a federal judge’s decision, Declared Title 42 illegal.” The outlet continued.

Chief Justice John Roberts referred the matter to the full court, which ruled 5-4 to uphold the verdict. Conservative Justice Neil Gorsuch, Trump’s first commissioner for the Supreme Court, sided with the court’s three dissenting liberals, claiming the court is acting like a legislature and setting guidelines for what Congress and the White House should do.

“It is hard to see why we should rush to review a judgment on a request for intervention in a case involving emergency orders that have expired,” he wrote in his dissent, noting that the COVID pandemic is largely over.

“And courts shouldn’t be busy pursuing administrative changes that are meant only for an emergency because elected officials failed to address another emergency,” Gorsuch added. “We are a court, not a decision-maker of last resort.”

Marsha (Catron) Espinosa, assistant secretary of public affairs for the Department of Homeland Security, said the Department of Homeland Security will enforce the policy.

“As required by today’s Supreme Court order, Public Health Order Title 42 remains in effect and persons attempting to enter the United States illegally will continue to be deported to Mexico or their home country,” she tweeted. “People shouldn’t listen to the lies of smugglers who take advantage of vulnerable migrants and put lives at risk. The border is not open and we will continue to fully enforce our immigration laws.”

As requested in today’s Supreme Court order, Public Health Order Title 42 remains in effect and persons attempting to enter the United States illegally will continue to be deported to Mexico or their home country.

Most Republicans agree the pandemic has run its course, but were nonetheless pleased with the Supreme Court’s decision to keep the policy pending review by a lower court.

“SCOTUS’ temporary suspension of Title 42 protections will prevent an increase in trafficking and drug trafficking. lives are saved. However, with the Democrats recently rejecting my efforts to legislate to remedy this situation, it falls to @POTUS to enforce the legislation currently on the books,” Sen. Mike Lee (R-Utah) tweeted.

“Today, SCOTUS gave Texas and the US a major victory by allowing Title 42 to stay in place after Biden illegally attempted to end this critical policy,” tweeted Texas Attorney General Ken Paxton, R .. “I will continue to fight at every turn and do everything in my power to secure our border and protect Texans.”

“I welcome the Supreme Court’s decision to keep Title 42, but the status quo is untenable.” Rep. Elect Monica De La Cruz, R-Texas., also noted this. “We need a long-term solution to our border crisis that protects American communities, holds the cartels accountable, and restores order to the border.”
